State Repression In fact during her incarceration Diane has been moved quite a number of times. In Washington from 1991 to 1993, she was held illegally in segregation, ordered by the Oregon authorities. The same occurred from 1993 to 1996 in California where Oregon also ordered the authorities not to allow her access to an Attorney. The Oregon Attorney General also ordered the Oregon State Penitentiary not to provide her with legal material for her appeal. Medical Experiments and Negligence Three times 'TB' testing was carried out during Diane's stay in New Jersey, (1989, 1990, 1991). Each inmate was injected with a substance from a vial marked A, B, or C. Each substance and corresponding vial was documented. Ninety per cent of the inmates 'tested' reacted to the injections. Two weeks following a reaction, each inmate who reacted was again injected from the corresponding vial A, B or C. This was 'not' normal TB testing procedure. Someone was experimenting on the inmates without their consent. Diane’s skull was fractured in 1988 and although the trauma team attended they refused her permission to see a doctor. She received a topical antibiotic, nothing more. As a result of the fracture she was suffering severe headaches a year later The doctor prescribed two pills. A week later a nurse quietly advised Diane to refuse one of the pills because it was an experimental drug and at least two people had died using it. In 1991 she was examined for back and abdominal pains and persistent fever. The doctor 'ordered' ten days room confinement. She was not provided with any medication whatsoever. She was not treated for these complaints until seven months and two transfers later. It was then discovered that she had been suffering a severe infection which had reduced her weight by some twenty pounds. Because the prison sat on one of the most dangerously affected radon-emission areas, someone had to do periodic radon-readings. The radon levels were so bad that staff didn't like inmates to close windows even in winter (open windows creating the illusion of air circulation). In addition, asbestos was discovered and never removed from the ceilings or crumbling showers. New Jersey was a death camp Himmler would have been proud of. The Oregon courts have determined that the law under which Diane was sentenced is illegal (in State v. Warren). The State of Oregon asked the Higher Court to reconsider that decision two and a half months ago (01 - 05 - 05). There should be no question that the Higher Court will concur with the lower Court because the Highest Court already ordered the Oregon Supreme Court to reverse the illegal sentencing (in State v. Dilts) and did as they were ordered. Its not likely they want to hand down a decision that the Supreme Court will 'again' order them to reverse. So all of Oregon knows the Supreme Court will affirm the Oregon Court of Appeals Warren decision. Incredibly the Oregon Supreme Court has decided to delay their opinion in Warren until the Oregon Court of Appeals hands down their opinion in State v. Heilman. After Heilman is decided in exactly the same way as Warren. The Oregon Supreme Court can then affirm both of them. It is worth noting that ex-D.A. Horton at one time received a suspension from the Oregon Bar for misconduct. Mr Jagger's career at the Bar is also tainted with forty five complaints in his file, three letters of admonition and three reprimands. back Top next |
